Eligibility Criteria

To be considered for the Law Researcher position, candidates must meet the following strict parameters:

  • Age Limit: Applicants must be between 21 and 28 years of age as on the date of the advertisement.
  • Academic Qualifications: Fresh Law Graduates or Post Graduates from a University/College recognized by the Bar Council of India are eligible to apply.
  • Final Year Students: Students currently studying in the 5th year of a 5-year law course or the final year of a 3-year law course may also apply. Their final selection is entirely subject to passing their final year LL.B. examination prior to engagement.
  • Minimum Marks: Only candidates who have passed all their examinations in the first attempt with a minimum of 60% aggregate marks are eligible to apply.
  • Required Recommendations: The application must be recommended by a designated Senior Advocate if the candidate is a practicing lawyer. If the applicant is not a lawyer, the recommendation must come from the Head of the last Law School/College/University they attended.

Terms of Engagement & Bar to Practice

  • Tenure: The initial contractual engagement is for a term of one year. This term may be extended once for an additional year, with the maximum period of engagement capped at two years.
  • Restrictions: During the term of engagement, the Law Researcher/Research Associate is strictly barred from practicing as a lawyer or taking up any full-time or part-time employment.
  • Post-Engagement: After termination, the individual cannot appear before the Hon’ble Judge they were attached to for a period of one year, nor can they ever appear in a case they worked on during their tenure.

Mandatory Enclosures and Recommendations

Roles and Responsibilities

The primary nature of the engagement is to assist the Hon’ble Judges in discharging their judicial and administrative duties. This is a full-time position that involves:

  • Reading case files and preparing comprehensive case summaries, notes, and chronological events.
  • Researching latest and governing case laws, articles, and papers relevant to the legal questions involved.
  • Remaining present in the Court during hearings to prepare notes of arguments and research citations.
  • Maintaining statistical reports and records of judgments passed by the assigned Hon’ble Judge.
  • Assisting in the preparation of speeches, academic papers, and important conferences.
  • Attending the residential office of the concerned Hon’ble Judge, in addition to normal duty hours, which may include working on gazetted or local holidays.

Leave Policy and Confidentiality

  • Casual Leave: Law Researchers are entitled to avail of Casual Leave as applicable to State Government employees, but no other type of leave is permitted.
  • Strict Secrecy: Candidates must maintain utmost secrecy regarding all official matters.

Resignation and Termination

  • Premature Resignation: If a Law Researcher intends to leave the engagement prematurely, they must provide a prior notice of two months, or the residuary tenure of their engagement, whichever is higher.
  • Termination by the Court: The High Court reserves the right to terminate the engagement by providing a one-month notice or one month’s salary in lieu thereof.

Bar to Practice and Professional Restrictions

To maintain the integrity of the position, strict professional restrictions apply:

  • No Private Practice: Selected candidates are strictly prohibited from practicing as a lawyer or taking up any other full-time or part-time employment during their term.
  • Post-Engagement Restrictions: After termination, the Law Researcher cannot appear before the specific Hon’ble Judge they were attached to for a period of one year. Furthermore, they are permanently barred from appearing in any case handled by that Judge if they had worked on that specific case during their engagement.
