Role Overview
We are seeking talented and driven legal professionals to join our Real Estate Practice in Mumbai. If you are looking to work on complex real estate transactions in a collaborative, high-growth environment, this is an excellent opportunity for you.
Key Responsibilities
- Title Searches & Due Diligence: Independently conduct title searches and due diligence for immovable properties across Maharashtra and other states as per client mandates.
- Document Verification: Scrutinize and verify the chain of title documents including sale deeds, gift deeds, partition deeds, wills, settlement deeds, exchange deeds, and other conveyance instruments.
- Revenue Records Analysis: Examine and interpret revenue records such as 7/12 extracts, property cards, mutation entries, ferfar certificates, and encumbrance certificates (Form XVI / Form XV).
- Risk & Defect Identification: Identify legal risks, defects in title, encumbrances, liens, easements, and pending litigation affecting subject properties.
- Legal Reporting: Prepare comprehensive Title Search Reports (TSR) and Legal Opinion Reports in the formats and checklists prescribed by banks, HFCs, and NBFCs.
- Authority Liaison: Liaise with Sub-Registrar offices, revenue authorities (Tehsildar / Talathi), municipal corporations, and urban development authorities for document verification and record searches.
- Regulatory Compliance: Advise on the rectification of title defects, missing link documents, and compliance with the Real Estate (Regulation and Development) Act, 2016 (RERA) and other applicable statutes.
- Security Creation: Assist in drafting and reviewing mortgage deeds, memoranda of deposit of title deeds, and other security creation documents as required.
- Data Confidentiality: Maintain strict confidentiality of client data, banking information, and property details in accordance with firm policies and data protection obligations.
Preferred Qualifications
- Experience: Direct experience working with Banks, HFCs, or NBFCs on title search mandates.
- Multi-State Practice: Knowledge of title search practices in additional states (Karnataka, Telangana, Tamil Nadu, Rajasthan, Delhi, Madhya Pradesh, West Bengal).
- Insolvency & Debt Recovery: Exposure to DRT / DRAT proceedings, SARFAESI enforcement, and insolvency-related property due diligence.
- Advanced Qualifications: LL.M. or a diploma in real estate laws is an added advantage.
