Key Responsibilities
1. Litigation & Dispute Resolution
- Court Appearances: Appear and argue independently before civil courts, criminal courts, tribunals, and labour forums on behalf of the company.
- Cheque Bounce Matters: Independently handle end-to-end Section 138 NI Act proceedings.
- Litigation Management: Track hearings, review orders, manage legal invoices, and maintain an updated litigation MIS tracker highlighting risk exposure for senior leadership.
2. Drafting & Commercial Contracts
- Pleadings: Draft plaints, written statements, affidavits, legal notices, replies, rejoinders, and applications across courts.
- Contract Vetting: Draft, review, and negotiate commercial agreements, including NDAs, vendor contracts, consultancy/service agreements, SLAs, MoUs, and leave & licence deeds.
- Repository Management: Maintain an updated contract repository and oversee renewal/expiry cycles.
3. Labour, Employment & Regulatory Compliance
- Labour Law: Oversee compliance under applicable central and state labour statutes.
- Dispute Handling: Represent the company before labour authorities and courts during conciliation and adjudication.
- Data Privacy: Advise on data protection regulations, including the Digital Personal Data Protection (DPDP) Act, 2023.
Key Skills & Qualifications
- Education: LL.B. or 5-Year Integrated B.A. LL.B. from a recognised university (LL.M. is preferred).
- Bar Council Enrolment: Active State Bar Council enrolment (Sanad) with a valid Certificate of Practice.
- Experience: 3 to 6 years of post-enrolment experience combining independent practice/law firm litigation and in-house corporate legal department exposure.
- Core Competencies:
- Strong court craft and independent drafting skills across civil, criminal, and commercial domains.
- Practical expertise in Section 138 NI Act procedures.
- Solid understanding of Indian labour & employment laws.
- Sound knowledge of data privacy principles (DPDP Act, 2023).
